Kumar went to the apartment of his daughter, who was out of station. In the apartment he found a man he did not know holding a bag with some of his daughter's belongings. He called the police, and the man was arrested and charged as a thief.
The next day in court, the prosecutor used Kumar's observations about the man as his sole evidence in support of the man's guilt. The man had no legal support, but the magistrate pointed out that Kumar did not live in the apartment and that it was not his property that was being allegedly stolen. He said that in the absence of any information from the daughter, he had no basis for determining whether or not the accused thief had permission to be in the apartment.
